Important Supreme Court Ruling

Screen Shot 2014-08-25 at 4.24.27 PM (1)The Supreme Court has overturned an Appellate Court’s decision that blocked a police officer from suing for a First Amendment violation.  A police officer in New Jersey was demoted by his superiors for, what they believed to be, engaging in activity relating to his political beliefs.  The police officer attempted to sue the department for violating his First Amendment rights but an appeals court ruled that there was no First Amendment conduct occurring and therefore, the officer could not contest his demotion.  The Supreme Court has reviewed the case and now overturned the Appellate Court’s ruling.  The Supreme Court has stated that the police officer may challenge his demotion because the First Amendment protects a person’s right to engage in political activity.  Since one of our areas of practice is police defense, we believe that this is a very important and great development.  Police officers have rights too and those rights need to be protected as well.  For the full story and case click here.
