Important DUI Case

The Illinois Bar Association recently published a list of relevant cases related to criminal law.  Check out the full case list by clicking here. We found a case related to DUI to be of particular interest. The People vs. Swanson deals with DUI and Fourth Amendment rights.  The defendant’s motion to suppress evidence was granted after police entered his home without permission or a warranted emergency in order to collect evidence for his DUI arrest.  The officers were not invited in by any party present and collected evidence which the court said was a violation of Fourth Amendment rights.  Without the evidence that was collected improperly, there was not enough evidence to support Swanson’s arrest for DUI and the case was thrown out.
