Happy Fourth of July!!!

This weekend is the Fourth of July and we here at LauraLaw want to wish everyone a happy holiday.  This year there will be many DUI checkpoints set up in order to catch those who are driving under the influence. While we love getting new clients here at the offices, we want to make sure that everyone stays safe this weekend and stays out of trouble with the law. The Fourth of July can be a very dangerous time of the year, and in order to stay safe keep the following tips in mind when celebrating:

1. Unlawful Use of a Weapon (720 ILCS 5/24-1)-The fourth of July is one of the most dangerous holidays. The last few Fourth of July holidays have been marked by violence in the form of accidental shootings and deaths caused by firearms. Last year there were roughly 71 shootings across Chicago with 13 deaths on the Fourth of July. We want to remind everyone that shooting a weapon into the air for recreational purposes is both dangerous and illegal. The Fourth of July holiday is meant to celebrate the United States independence and shooting guns in the air was not what the Founding Fathers envisioned.

2. Fireworks- The Pyrotechnic Use Act (425 ILCS 35/2) in Illinois specifically states that fireworks are a danger to public health and safety and that the sale, possession, or use of fireworks is illegal in the state of Illinois. Possession of fireworks or using them is considered a Class A misdemeanor and could hold penalties of up to 1 year in prison and a $2,500 fine. Illinois Fire Marshals have warned to leave the fireworks to the professionals. Fireworks shows will be plentiful both Friday and Saturday of this weekend.  Click here to check out a full list of professional fireworks displays by county.

3. Driving under the influence (625 ILCS 5/11-501) – This holiday weekend there will be increased police presence and DUI checkpoints across the state. Make sure that your car is up to date with insurance, and that all head lights, tail lights, and other necessary fixtures are in place on your car as a violation of these would be probable cause for a police officer to pull you over. As always never consent to a search. The Fourth of July is also one of the most dangerous holidays involving car accidents as well, so be safe while driving. You can also take the CTA, which has extended its hours this weekend for the holiday.

4. Cannabis Control Act (720 ILCS 550/4) – We all know the fourth of July is a time to celebrate and people celebrate different ways. Make sure that if you are attending any festivals this weekend that you check out our post on festivals and drugs. Possession of cannabis is still a crime in Illinois so make sure to be aware of this while celebrating.

5. Curfew (720 ILCS 5/12C-60) – Curfew applies to children under 17 and the curfew hours are from 11 p.m. to 6 a.m. Sunday through Thursday, and 12:01 a.m. to 6 a.m. Saturday and Sunday mornings.  Violation of curfew carries fines ranging up to $500 or community service depending on the location of the offense.

6. Mob Action (720 ILCS 5/25-1) – A mob is defined as a group of 2 or more persons arranging together in order to knowingly commit a felony or misdemeanor. These mobs, or “flash mobs” as they are more commonly known, are usually formed of a large number of young persons. Recently these mobs have been ransacking stores and robbing people on the street. Make sure to be aware of your surroundings and keep an eye on your belongings when near large groups of people. To be safe make sure to never walk alone.
